2. Use of the Site
You agree to use the Site only for lawful purposes. You must not:

3. Enquiries and Quotes
Submitting an enquiry, quote request, or "Get a Free Website Quote" form does not create a binding contract between you and MediaBar. A formal engagement begins only once both parties agree to a scope of work, pricing, and timeline, typically confirmed in writing (email or a signed proposal/invoice).
Quoted prices are estimates based on the information provided at the time of enquiry and are subject to change once full project requirements are assessed.
4. Services and Delivery Timelines
- We aim to deliver standard business websites and Shopify/WooCommerce stores within 10–15 working days from brief approval, and complex projects (multi-language sites, custom integrations, custom apps) may take longer and will be scoped individually.
- Timelines are estimates and may vary due to factors including client responsiveness, content/asset delivery delays, and scope changes.
- Delivery of any project is contingent on the client providing necessary content, access credentials, and timely feedback/approvals.
5. Payments
- Project pricing is fixed and itemized as agreed in the proposal or invoice shared with the client before work begins.
- Payment terms (e.g., advance/milestone/final payment split) will be specified in the project proposal or invoice.
- Where applicable, payments may be processed through third-party payment gateways such as Razorpay or Stripe, which have their own terms and privacy practices.
- Failure to make payments as agreed may result in suspension of services or project deliverables.
6. Client Responsibilities
To ensure timely delivery, clients agree to:
- Provide accurate project requirements, brand assets, and content in a timely manner
- Respond to requests for feedback, approvals, or clarification within a reasonable time
- Ensure they have the legal right to use any content, images, logos, or trademarks they provide to us for use in their project
7. Intellectual Property
- All content on the Site — including text, graphics, logos, and design elements — is the property of MediaBar unless otherwise stated, and may not be copied, reproduced, or used without our written permission.
- Upon full and final payment for a client project, ownership of the final delivered website/design (excluding third-party licensed assets, stock images, plugins, or code libraries) transfers to the client, unless otherwise agreed in writing.
- MediaBar reserves the right to showcase completed client projects in its portfolio, case studies, and marketing materials unless the client requests otherwise in writing.
8. Third-Party Tools and Platforms
Our services may involve integration with third-party platforms such as WordPress, Shopify, WooCommerce, Wix, Meta Ads, Google Ads, Stripe, and Razorpay. We are not responsible for outages, policy changes, pricing changes, or service interruptions caused by these third-party platforms.
9. Limitation of Liability
To the fullest extent permitted by law, MediaBar shall not be liable for any indirect, incidental, special, or consequential damages arising out of or related to your use of the Site or our services, including but not limited to loss of revenue, data, or business opportunities. Our total liability for any claim arising from our services shall not exceed the amount paid by the client for the specific project giving rise to the claim.
10. Indemnification
You agree to indemnify and hold MediaBar harmless from any claims, damages, or expenses arising from your misuse of the Site, violation of these Terms, or infringement of any third-party rights (including intellectual property rights) through content you provide to us.
11. Third-Party Links
The Site may contain links to third-party websites for reference or portfolio purposes. We are not responsible for the content, accuracy, or practices of these external sites.
12. Termination
We reserve the right to suspend or terminate access to the Site, or decline/discontinue a service engagement, at our discretion — including in cases of non-payment, misuse, or breach of these Terms. Termination of an ongoing project will follow the cancellation/refund terms specified in the relevant project proposal or invoice.
13. Governing Law
These Terms are governed by and construed in accordance with the laws of India. Any disputes arising from these Terms or our services shall be subject to the exclusive jurisdiction of the courts in Delhi, India.
14. Changes to These Terms
We may update these Terms from time to time. Continued use of the Site or our services after changes are posted constitutes acceptance of the revised Terms.
